Terms of Service for I Choose Sober
These Terms of Service (“Terms”) govern your use of the I Choose Sober mobile application (“the app”) published by BDKM LLC (“we”, “us”, or “our”). By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the app.
1. The app
I Choose Sober is a shame-free sobriety companion that helps you make a simple daily choice to stay alcohol-free, remember the people and reasons you are choosing, and see your progress through streaks, a sober-days calendar, and the money you are winning back. The app is local-first, your data is stored on your device, and it has no account. See our Privacy Policy for details.
2. Not medical advice, and not a crisis service
Important. I Choose Sober is a self-help support tool. It is not medical treatment, not therapy, not a healthcare provider, and not an emergency or crisis service. It does not provide medical advice, diagnosis, or treatment.
Recovery from alcohol use is a serious matter, and stopping drinking can carry real medical risks. Alcohol withdrawal can be dangerous and, for some people, requires medically supervised care. Consult a qualified healthcare or addiction professional about your situation, and do not rely on the app in place of professional treatment.
The app is not monitored in real time and cannot help in an emergency. If you are in crisis or thinking about harming yourself, contact your local emergency services now. In the United States you can call or text 988 (the Suicide and Crisis Lifeline). Outside the United States, use your local crisis or emergency resources.
You use the app and act on anything in it at your own risk.
3. Eligibility
You must be old enough to form a binding contract in your jurisdiction and meet the minimum age in your region (at least 13, or higher where required) to use the app. The app is intended for adults.
4. Your responsibilities
You agree to:
- Use the app only for lawful, personal, non-commercial purposes.
- Provide accurate information if you choose to enter it (the app works without it).
- Not attempt to reverse engineer, decompile, interfere with, or disrupt the app except to the extent that applicable law permits.
- Keep your device secure, since your data is stored on it.
5. Your data and content
Anything you enter, such as your reasons, photos of loved ones, and your daily check-ins, is yours. Because the app stores it on your device, you are responsible for it, including keeping your own backups. We are not responsible for data lost due to device failure, loss, or app uninstallation. 6. No account
I Choose Sober has no sign-up, login, or password. You do not create an account or give us any credential to use the app, and there is nothing for us to hold about you on our side.
7. Purchases
This version of the app is provided free of charge. If we introduce paid features or subscriptions in the future, the applicable prices and terms will be presented to you at the point of purchase and processed by the Apple App Store or Google Play under their terms. Any such purchases will be governed by additional terms shown at that time.
8. Intellectual property
The app, including its design, branding, logos, text, and software, is owned by BDKM LLC and protected by intellectual-property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app for your own personal use. You may not copy, modify, distribute, sell, or lease any part of the app.
“I Choose Sober”, “BDKM”, and associated logos are marks of BDKM LLC.
9. Third-party links and services
The app may link to other BDKM apps, to third-party services (such as app stores or our website), and to the 988 crisis line in the United States. We are not responsible for the content or practices of third-party services. Your use of them is governed by their own terms and privacy policies.
10. Disclaimers
The app is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the app will be uninterrupted, error-free, or that any result (such as staying sober or any health outcome) will be achieved. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
11. Limitation of liability
To the maximum extent permitted by law, BDKM LLC and its owners and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, health consequences, profits, or revenues, arising out of or related to your use of (or inability to use) the app, even if advised of the possibility of such damages. Where liability cannot be excluded, our total liability is limited to the amount you paid for the app (which for this version is zero).
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence where that cannot be excluded.
12. Indemnification
You agree to indemnify and hold harmless BDKM LLC from any claims, damages, or expenses arising out of your misuse of the app or your violation of these Terms.
13. Termination
You may stop using the app at any time by uninstalling it. We may suspend or discontinue the app, or any feature, at any time. Sections that by their nature should survive termination (including Sections 2, 5, 8, 10, 11, and 12) will survive.
14. Changes to these Terms
We may update these Terms as the app evolves. When we do, we will revise the “Last updated” date above and, for material changes, provide notice in the app or on this page. Continued use after an update means you accept the revised Terms.
15. Governing law
These Terms are governed by the laws of the United States and the State in which BDKM LLC is organized, without regard to conflict-of-laws principles, except where local consumer-protection law gives you additional rights that cannot be waived.
